These Terms & Conditions apply to the use of the Time & Tide Brewing website and to purchases made through our website.
Please read these terms carefully before placing an order. By placing an order with us, you agree to these Terms & Conditions.
Nothing in these terms affects your statutory rights as a consumer.
1. ABOUT US
This website is operated by Time & Tide Brewing (“Time & Tide”, “we”, “us” or “our”).
Our brewery is based in Kent, England.
For questions about an order or these Terms & Conditions, please contact:
Our registered company information is displayed on our website.
2. AGE RESTRICTIONS
You must be 18 years of age or over to purchase alcohol from us.
By placing an order containing alcohol, you confirm that you are aged 18 or over and that any person accepting delivery will also satisfy any applicable age-verification requirements.
We and/or our delivery partners may require proof of age before alcohol is handed over. If satisfactory proof of age cannot be provided when required, delivery may be refused.
We reserve the right to refuse or cancel an order where we reasonably believe alcohol is being purchased by, or on behalf of, somebody under the age of 18.
3. PLACING AN ORDER
When you place an order through our website, you are offering to purchase the products shown in your order.
Orders are subject to availability and acceptance by us.
Please check your order carefully before completing your purchase. You are responsible for ensuring that the products, quantities, email address, billing address, delivery address and other information supplied or approved during checkout are correct.
Where you use Apple Pay, Google Pay, PayPal or another digital wallet or accelerated checkout service, information associated with that service may automatically be supplied during checkout. It is your responsibility to check that the information shown is correct and up to date before confirming your order.
We cannot accept responsibility for errors in information supplied or approved by you, although we will always try to assist where reasonably possible.
4. ORDER CONFIRMATION
Once an order has been successfully placed, an order confirmation will normally be sent to the email address supplied during checkout.
It is your responsibility to provide a valid email address and to check your inbox, including spam and junk folders, for communications relating to your order.
Not receiving or locating an order confirmation does not necessarily mean that an order has not been placed.
If you are unsure whether your order has been successful, please contact us before placing another order.
Where a customer places a duplicate order because they have not seen or received an order confirmation, we will try to assist if contacted promptly, but we cannot guarantee that an order can be cancelled once it has entered fulfilment or been dispatched.
5. ACCEPTANCE OF ORDERS
Receipt of an automated order confirmation does not necessarily constitute our acceptance of an order.
We reserve the right to refuse or cancel an order before dispatch where reasonably necessary, including where:
a product is unavailable;
there is an obvious pricing or product-description error;
payment has not been authorised;
we are unable to deliver to the address supplied;
we reasonably suspect fraud or misuse;
we reasonably believe the purchase would breach licensing requirements; or
circumstances outside our reasonable control prevent us from fulfilling the order.
If we cancel an order after payment has been taken, we will refund the amount due.
6. PRICES AND PAYMENT
All prices are shown in pounds sterling (£) and include VAT where applicable unless stated otherwise.
Any applicable delivery charges will be displayed before you complete your purchase.
Payment must be successfully completed before an order is dispatched.
We take reasonable care to ensure prices are correct. If an obvious pricing error occurs, we are not obliged to supply a product at an obviously incorrect price.
Where an error affects an order already placed, we may contact you to offer the opportunity to purchase at the correct price or cancel the affected item or order.
7. PRODUCT AVAILABILITY
All products are subject to availability.
Our beers are produced in batches and availability may change quickly. Occasionally an item may become unavailable after an order has been placed.
Where we cannot fulfil part or all of an order, we may contact you regarding an appropriate alternative or refund the affected item.
We will not substitute a materially different product without your agreement unless the nature of the product or offer clearly provides for substitutions.
8. PRODUCT INFORMATION
We take reasonable care to ensure that descriptions, photographs, prices, ABVs, ingredients, allergens and other product information displayed on our website are accurate.
However, packaging, labels, artwork, vintages, batches and other aspects of presentation may occasionally differ from photographs displayed on the website.
Customers with allergies or specific dietary requirements should review the ingredient and allergen information provided before purchasing.
If you require further information about a product before ordering, please contact info@timeandtidebrewing.co.uk.
9. BEER QUALITY AND STORAGE
Beer is a consumable product and should be stored and consumed in accordance with any instructions provided on the product.
Where appropriate, we recommend storing beer in a cool, dry place away from direct sunlight and consuming it within the best-before guidance provided.
Some of our beers may be unfiltered or naturally conditioned. Natural sediment, haze or variations between batches are not necessarily indications that a product is faulty.
Once products have been delivered, we cannot accept responsibility for deterioration resulting from inappropriate storage, exposure to excessive heat or cold, mishandling or storage beyond the recommended period.
Nothing in this section affects your statutory rights where a product was faulty or not of satisfactory quality when supplied.
10. DELIVERY
We deliver orders to the delivery address supplied or approved when the order is placed.
Delivery dates and times are estimates unless we have expressly agreed otherwise.
You are responsible for providing a complete and accurate delivery address and any information reasonably required to enable delivery.
Once an order has entered fulfilment or been dispatched, we may not be able to change the delivery address.
Where tracking information is provided, customers are encouraged to monitor the progress of their delivery and contact us promptly if there appears to be a problem.
11. INCORRECT ADDRESSES AND CUSTOMER DETAILS
We fulfil orders using the information provided or approved by the customer during checkout.
If an order is sent to an incorrect address because incorrect or outdated information was supplied or approved by you, we will try to assist but we cannot guarantee that the parcel can be recovered or redirected.
Where an order is returned to us because of an incorrect or incomplete customer-supplied address, we may require payment of reasonable additional delivery costs before resending it.
Nothing in this section limits our responsibility where an error has been caused by us or our delivery provider.
12. FAILED OR REFUSED DELIVERY
Customers are responsible for ensuring that somebody who can lawfully accept the delivery is available where required.
Delivery may be refused where appropriate proof of age cannot be provided.
Where a delivery fails because:
nobody is available to accept it where required;
satisfactory proof of age cannot be provided;
access to the delivery address is not reasonably possible;
an incorrect or incomplete address has been supplied; or
the customer refuses delivery without a legal entitlement to do so,
we may require payment of reasonable additional delivery or redelivery costs.
13. DAMAGED DELIVERIES
If your order arrives visibly damaged, please contact us as soon as reasonably possible at:
Please provide your order number, details of the damage and, where reasonably possible, photographs of the packaging and affected products.
Photographs help us investigate the issue with our delivery provider and resolve the matter more quickly.
Please retain damaged packaging and products until we confirm whether they need to be kept, returned or disposed of.
14. FAULTY, DAMAGED OR INCORRECT GOODS
If goods supplied by us are faulty, damaged, not as described or we have sent an incorrect product, please contact us as soon as reasonably possible.
Where goods do not conform to the contract, we will provide the remedy required by applicable consumer law.
Depending upon the circumstances, this may include replacement, refund, repair where appropriate, or another remedy required by law.
Where we require faulty or incorrectly supplied goods to be returned, we will bear the reasonable cost of returning them.
Damage caused after delivery through misuse, accident, inappropriate storage or handling by the customer is not considered a product fault.
15. OUR RETURNS POLICY
We do not offer a voluntary returns or exchange policy beyond your statutory rights.
We do not therefore routinely accept unwanted products simply because a customer has changed their mind, except where a statutory cancellation right applies.
Nothing in these Terms & Conditions restricts your statutory consumer rights.
16. STATUTORY CANCELLATION RIGHTS
For eligible purchases made online, consumers may have a statutory right to cancel their purchase within 14 days of receiving the goods without giving a reason.
If you wish to exercise a statutory cancellation right, you must notify us clearly of your decision to cancel.
Please contact:
and provide sufficient information for us to identify your order.
Where the statutory cancellation right applies, goods must be returned without undue delay and no later than 14 days after you tell us that you are cancelling.
Statutory exceptions to cancellation rights apply to certain goods and circumstances.
17. COST OF RETURNS
Where a return is required or permitted, the customer is responsible for arranging and paying the return costs, except where the item is faulty, damaged or incorrect, or where otherwise required by law.
This includes eligible statutory change-of-mind cancellations.
This also applies where the original order qualified for free delivery.
Free delivery on the original order does not mean that we will pay the cost of returning unwanted goods.
We recommend using an appropriate tracked delivery service for returned products.
18. CONDITION OF RETURNED GOODS
Where you exercise a statutory cancellation right, you may handle goods only to the extent reasonably necessary to establish their nature, characteristics and functioning.
You are responsible for taking reasonable care of goods while they are in your possession.
Where handling beyond what would reasonably be permitted in a shop has reduced the value of the goods, we may make an appropriate deduction from any refund where permitted by law.
Goods should therefore be returned in substantially the condition in which they were received and, where reasonably possible, with their original packaging.
19. REFUNDS REQUIRED BY LAW
Where you are legally entitled to a refund, we will provide it in accordance with applicable consumer law.
Where a statutory cancellation right applies and you paid for delivery, our obligation to refund the original delivery charge is limited, where permitted by law, to the cost of our least expensive standard delivery option.
Where permitted, we may withhold reimbursement until we have received the returned goods or you have provided evidence that they have been sent back, whichever occurs first.
Refunds will normally be made using the original payment method unless otherwise agreed.
20. CHANGING OR CANCELLING AN ORDER AFTER IT HAS BEEN PLACED
Orders may be processed quickly.
If you notice an error or wish to change an order, please contact us immediately.
We will make reasonable efforts to help where an order has not yet entered fulfilment, but we cannot guarantee that an order can be changed or stopped once it has been placed.
Once an order has been dispatched, the cancellation and returns provisions above will apply where relevant.
21. PROMOTIONS AND DISCOUNT CODES
Promotional offers and discount codes may be subject to additional conditions displayed with the relevant promotion.
Unless stated otherwise:
promotional codes cannot be exchanged for cash;
discounts cannot be applied retrospectively;
only one promotional code may be used per transaction;
promotions are subject to availability; and
promotional offers cannot be combined unless expressly permitted.
We reserve the right to withdraw, amend or refuse a promotional code where reasonably necessary, including where we reasonably believe it has been misused.
This does not affect orders already accepted on the applicable promotional terms.
22. FREE DELIVERY OFFERS
Any free-delivery offer applies only where the conditions of that offer are satisfied.
Free delivery relates to the original shipment of the order.
It does not entitle the customer to free return postage or free redelivery where additional delivery is required because of circumstances attributable to the customer.
23. GIFT CARDS AND VOUCHERS
Gift cards and vouchers are subject to any specific terms displayed when purchased.
Unless otherwise stated:
gift cards have no cash value and cannot be exchanged for cash except where required by law;
they must be used before any stated expiry date;
lost or stolen vouchers may not be replaceable where we cannot reasonably verify ownership; and
promotional discounts may not apply to gift-card purchases.
Nothing in this section affects statutory rights.
24. EVENTS AND EVENT TICKETS
We may sell tickets to events organised by Time & Tide or involving Time & Tide through our website.
Any event-specific conditions displayed at the point of purchase form part of these Terms & Conditions.
Unless otherwise stated, event tickets are non-refundable except where required by law or where the event is cancelled by us.
A customer's inability to attend, change of plans, travel disruption, illness or other personal circumstances do not normally entitle the ticket holder to a refund, except where required by law.
Customers are responsible for checking the event date, time, location, session and number of tickets before completing their purchase.
Where an event is age restricted, customers are responsible for ensuring that they and anyone for whom they purchase tickets satisfy the applicable requirements.
Admission may be refused where appropriate proof of age cannot be provided.
25. EVENT CHANGES
Occasionally it may be necessary to make reasonable changes to an event, including changes to participating breweries, beers, entertainment, running order, timings or other elements.
Minor or reasonable changes to an event do not automatically entitle ticket holders to a refund.
If we cancel an event, we will provide the remedy required by applicable law and communicate arrangements to affected ticket holders.
Nothing in this section affects statutory rights.
26. BEERS AND PRODUCTS AT EVENTS
Where an event advertises particular beers, breweries, food traders, performers or other participants, these are subject to availability and may change due to circumstances outside our reasonable control.
Unless expressly stated otherwise, a ticket does not guarantee the availability of any particular beer, brewery, product, food trader or performer.
27. CHARGEBACKS AND PAYMENT DISPUTES
If you believe there is a problem with an order, please contact us first at info@timeandtidebrewing.co.uk so that we have an opportunity to investigate and resolve the issue.
Nothing in these terms prevents you from exercising any lawful rights you may have through your payment provider or card issuer.
We reserve the right to provide order information, delivery information, correspondence and other relevant evidence to payment providers, banks or card issuers where necessary to respond to a payment dispute or chargeback.
28. FRAUD AND MISUSE
We reserve the right to refuse or cancel orders where we reasonably suspect fraud, unauthorised payment activity, abuse of promotions or other unlawful activity.
We may take reasonable steps to protect our business, customers and payment systems, including providing relevant information to payment processors, fraud-prevention providers or authorities where lawful and appropriate.
29. WEBSITE AVAILABILITY
We aim to keep our website available and accurate but cannot guarantee uninterrupted access.
We may temporarily suspend or change parts of the website for maintenance, security, technical or operational reasons.
We are not responsible for temporary website unavailability where this is outside our reasonable control.
30. WEBSITE USE
You may use our website for lawful personal purposes.
You must not:
deliberately misuse the website;
attempt to gain unauthorised access to the website or associated systems;
introduce viruses, malicious code or other harmful material;
interfere with the operation or security of the website;
use automated systems to access the website in a way which places an unreasonable burden on it; or
use the website for fraudulent or unlawful purposes.
31. INTELLECTUAL PROPERTY
Unless otherwise stated, content on our website including the Time & Tide name and branding, beer names, artwork, photographs, illustrations, text, graphics and designs belongs to us or is used by us with permission.
Website content may be viewed and used for personal, non-commercial purposes.
It may not be reproduced, distributed, modified or commercially exploited without the permission of the relevant rights holder.
32. THIRD-PARTY WEBSITES AND SERVICES
Our website may contain links to websites or services operated by third parties.
We do not control third-party websites and are not responsible for their content, availability, security, terms or privacy practices.
The inclusion of a link does not necessarily constitute our endorsement of the third party.
33. EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for delay or failure to perform our obligations where this results from circumstances outside our reasonable control.
These may include severe weather, transport disruption, courier network disruption, fire, flood, industrial action, epidemic or pandemic restrictions, government action, failure of utilities or communications networks, or other events which we could not reasonably prevent.
Where such circumstances materially affect an order or event, we will take reasonable steps to minimise the impact and comply with our legal obligations.
34. OUR LIABILITY
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.
This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and consumer rights or other liabilities which cannot lawfully be excluded or restricted.
We are not responsible for losses which were not reasonably foreseeable when the contract was entered into or losses arising from matters for which we are not legally responsible.
Products purchased by consumers through our website are supplied for private use. We are not responsible for business losses arising from a consumer purchase except where the law provides otherwise.
35. YOUR STATUTORY RIGHTS
These Terms & Conditions are intended to set out our respective rights and responsibilities clearly.
Nothing in these terms excludes, restricts or overrides any consumer right which cannot legally be excluded or restricted.
Where there is a conflict between these Terms & Conditions and a mandatory statutory consumer right, the statutory right will apply.
36. PRIVACY
Our collection and use of personal information is governed by our separate Privacy Policy.
Please refer to that policy for information about how we collect, use, store and protect personal information and about your data protection rights.
37. COMPLAINTS
If something has gone wrong, please contact us so that we have an opportunity to investigate and resolve the matter.
Please email:
Where your enquiry relates to an order, please include your order number and sufficient information for us to identify the transaction.
38. SEVERABILITY
If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue to apply.
39. WAIVER
If we do not immediately enforce a provision of these Terms & Conditions, this does not mean that we have waived our right to enforce it later.
40. GOVERNING LAW
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you will retain the benefit of any mandatory consumer protections and rights relating to where proceedings may be brought which apply to you.
41. CHANGES TO THESE TERMS
We may update these Terms & Conditions from time to time to reflect changes to our business, products, website, services or legal requirements.
The Terms & Conditions applying to an order will normally be those in force at the time the order is placed.
